State of Emergency: The Mass 201 CMR 17 Privacy Law— What You Need to Know

With the latest deadline for Mass 201 CMR 17 looming on January 1st 2010, businesses that own, license, store, or maintain the personal information of Massachusetts residents need to assess their environments for readiness. The regulation is aimed at any business—regardless of where that business is located—that touches a Massachusetts resident’s personal information. While this is a call to action to help proactively protect Massachusetts residents’ personal information, it has far reaching impacts for businesses that handle personal information and may set the bar for other states or even federal adoption.

Overall, the regulation aims to provide a high level organizational and technical blueprint for businesses to adhere to in order to help protect personal information in their environment. Many organizations will find that that they may already be largely in compliance if their security program is well established.

Others, especially small and medium sized businesses, may find that they are lacking in certain areas—data encryption requirements for example—and will need a significant amount of work to become compliant. More on that later!
